As lawyers, we're often asked about property damage after an accident. Who has to pay for it, and what do they have to pay? It depends on who's at fault. Is the other party clearly at fault? If they are, then it's best to go right to their insurance company because they are going to have to pay, and they won't have to be subject to a deductible. They will probably have to pay for any towing, storage, and rental car that's involved in this situation. But, if the other party involved in the accident is not clearly at fault if you might be partially at fault, then it's best to go to your own insurance company first even if you have a deductible to pay because your own insurance company is going to pay you more promptly than the other insurance company.
